			<content:encoded><![CDATA[<p>If you&#8217;re looking for a place to live near downtown Austin that still has a community feel, look no further than the Great Hills neighborhood. This area has been part of the Austin landscape since the 1970s and it has grown by leaps and bounds, while still holding onto the neighborhood feel. It&#8217;s got a lot of freeway accessibility, a variety of restaurants and stores to choose from and it&#8217;s very close to downtown Austin so residents can take part in the amenities there as well.</p>
<p>Great Hills resides near the intersection of Loop 360 and Highway 183. The northern boundary of the neighborhood is Fireoak Drive/Rain Creek parkway and it is bordered by Rain Creek parkway and Yaun Drive on the east and west, respectively. Although most residents travel by car, there are a few Capital Metro stops in the Great Hills area.<span id="more-2166"></span></p>
<p>The residents are a good mix of young married folks, families, older students and young professionals. About half of the people in the area rent their homes, and there are many apartment complexes in the area. If you&#8217;re interested in buying in this area, there&#8217;s something for every price range. In 2008, the prices ranged from $200,000 up above $700,000. Although the neighborhood was established in the 1970s, there are homes that have been built as recently as the early 2000s.</p>
<p>It isn&#8217;t as family oriented as other areas of Austin, but there are still a lot of families to connect with if you do have children. There are two different school districts represented in the Great Hills neighborhood, depending on where you live. The Austin Independent School District includes Hill Elementary, Murchison Middle School and Anderson High School. The Round Rock Independent SchoolD District includes North Oaks Elementary, Canyon Vista Middle School and Westwood High School.</p>
<p>If you like outdoor activities, there are many different options in the Great Hills neighborhood. Social memberships are available to the Great Hills Country Club which afford you access to the tennis courts, the pool and the club house. The club also features an excellent golf course. The Austin Hills Park is another popular location in the neighborhood for outdoor activities. It has a nature trail for hiking, playground equipment and picnic tables. Bull Creek Park features wide open green lawns, swimming and hiking.</p>
<p>For amenities, there are several shops and restaurants in Great Hills. It&#8217;s also close to the Arboretum area which has a lot of shopping and eating opportunities. This outdoor mall like structure features popular stores and restaurants like Barnes and Noble, the Cheesecake Factory, REI and Whole Foods. There are also two movie theaters and several coffee shops.</p>
<p>All in all, Great Hills is considered to be one of the most convenient places to live in Austin. It&#8217;s close to shopping, has great schools and a real community environment, along with some terrific outlets for outdoor activities. 			<content:encoded><![CDATA[<p>The Truth in Lending Act or TILA was originally passed by Congress in 1968 as part of the much larger Consumer Protection Act. It was designed as a way to protect consumers during credit transactions. It requires lenders to provide clear disclosure of any key terms in a lending agreement, including all the costs involved therein. The law was further reformed, and it was simplified in 1980 as part of the Depository Institutions Regulations and Monetary Control Act.</p>
<p>TILA is especially important in that it helps to protect consumers in credit transactions and leasing. Lending institutions can held liable under the Truth in Lending Act, regardless of the intent of the creditor or the nature of the violation. The Act is to be liberally construed in favor of consumers, and this creates less wiggle room for lenders if they fail to comply with any part of the act.<span id="more-2154"></span></p>
<p>Before credit is extended to a consumer, disclosure is generally required, and it must be made in periodic billing statements in some cases. Disclosure must be made with regard to: Finance charges, annual percentage rate, amount financed, total of payments to be made and total sales price.</p>
<p>In addition, a lender must keep evidence that it complied with TILA requirements for at least two years after the date when disclosure was made, and clear and conspicuous evidence of disclosure must appear on the document that is to be given to the consumer.</p>
<p>A very important aspect of the Truth in Lending Act is the right of rescission, and lenders are required to deliver two copies of the notice of the right to rescind and one copy of the disclosure statement to whichever consumer has the right to rescind.</p>
<p>If a consumer chooses to exercise the right to rescind, he/she must notify the lender by mail or other means of communication. It is considered that notice is given when it is mailed or sent by any other means, and/or when it is delivered to the lenders&#8217; place of business.</p>
<p>The consumer maintains the right to rescind and may exercise it until midnight of the third business day after the transaction has taken place, delivery of the notice of right to rescind, or the delivery of all disclosure materials, whichever is done last. The security interest will therefore become void, and the consumer cannot be liable for any amount, including any finance charge.</p>
<p>Since mortgage transactions are becoming more complicated, with loans of various durations, interest rates variations, and other terms available to buyers, a booklet has been published by the Federal Reserve Board and the Federal Home Loan Bank Board. It was published with the idea of helping consumers understand the purpose of adjustable rate mortgages and their use.</p>
<p>Lenders offering these types of mortgages are required to make this booklet, or one similar to it, available to home buyers. If the consumer is well informed, then he/she will know about the different types of loans, how they work and which one would better serve his/her needs. The idea is for consumers to educate themselves in order to know their rights and options, and to know when predatory lending practices and bank fraud are being used.</p>

<p>According to the census bureau homeownership fell to 67.2% at the end of 2009 which puts current levels of ownership at the lowest rate in ten years. Understandably, home ownership is lowest in areas where the cost of owning a home is highest and the biggest drops have occurred in the states that have been hardest hit with foreclosures. Vacancy rates have risen as home ownership has fallen; there were approximately 100,000 more homes sitting vacant at the end of 2009 than there were only mere months earlier. <span id="more-2138"></span></p>
<p>Although the collection of foreclosures is still accumulating and unemployment rates continue to sit at high levels, there seems at last to be some hope on the horizon for those holding out for an end to the declining of home prices though. Experts report that home value decreases have been slowing over the previous year, even as so many of the factors that hinder the market’s recovery have continued to be a problem for the real estate market.</p>
<p>It may be some time yet before home values actually rise again, however. It is expected that the large number of vacant properties will keep pressure on keeping housing prices down because it helps create a buyer’s market. With unemployment still at high levels across much of the country as well, there are fewer people who can afford to buy into this suppressed market at this time to take advantage of the excess housing supplies and low prices even with the reasonable interest rates and tax credits that are still available.</p>
<p>The next few months will be a telling time for many potential buyers and sellers as the markets continue to rebalance themselves and home values find a new level of equilibrium. Hopefully the market can find a balance that home owners across the nation can live with.</p>

			<content:encoded><![CDATA[<p>Lately, there have been lots of people asking me the difference between lease option, rent to own and the Famous Rent to Own on Steroids Program(tm).  I  know that there are even more people who do not know and don&#8217;t ask. I am always impressed when someone asks.  It means they are already knowledgeable,  self confident, and desire to increase their learning.</p>
<p>The three phrases are quite similar in what they propose to do, which is to move the title of a house from one person to another, usually avoiding the use of commercial banks and is designed to accommodate those who can not or do not want to deal with banks.  Here are some differences.<span id="more-2132"></span></p>
<p>Lease option is a lease and an option.  They may be combined into one document or may be two and there are variations of them, like a lease with contract for option.  The basic lease option provides for the buyer to rent under the terms of the lease with the right (but not the obligation) to buy the property at terms and prices stated in the option document.  Normally there is something like first, last and security  to be paid for the lease.  There is also option premium (the amount you pay to buy an option) which gives the buyer the right, but not the obligation to buy.</p>
<p>The option will state the term of the option and the strike price or prices.  The strike price is the price the buyer can buy the house for at various periods of time.  For example, it would be possible to buy at $100,000 for 12 months and maybe $105,000 in the second 12 months and there would be a date specific at which time the option would expire and then  become worthless.</p>
<p>If prices of the houses go up the buyer would be more likely to exercise his option and buy the house. If prices went down, he  could simply choose not to buy.  Which means he would not have to sell the house, would not have to pay marketing and sales so costs and could simply leave as he could under the terms of the lease.</p>
<p>Some of the money paid usually becomes a credit for the buyer.  The lease option may or may not also provide a mortgage for the buyer and may state the terms of the mortgage.</p>
<p>Rent to Own is a more generic term.  Basically it means the same as lease option and is usually used for lower priced houses.  A $150,000 house might be available as a rent to own.  a $900,000 house would be more likely to be offered as a lease option.  But both terms would really be equally applicable for high and low priced houses and usage would tend to be a function of who is talking to whom.</p>
<p>Famous Rent to Own 0n Steroids Program(tm) is a specific kind of rent to own, or lease option, with really incredible features.</p>
<p>First  ALL of the money you pay in the first year becomes your down payment.  That is option premium and all rent becomes down payment.</p>
<p>Second there is a guaranteed mortgage program with the Famous Program.  Make 12 consecutive monthly payments on time and maintain the house at though it were you own already and you get a mortgage.</p>
<p>You EARN a mortgage.  You do not Qualify for a mortgage so there is no credit score.<br />
YOU DO NOT QUALIFY FOR THE MORTGAGE.</p>
<p>You may qualify to get into the lease portion, but there is a program that offers no credit check to get into the lease.</p>
<p>The Famous Rent to Own on Steroids Program(tm) is Trade Marked by the United States Patent Office and there is a detailed treatment of the entire process in the book 911 For Landlords.  Most landlords are reluctant to offer this program because they think it is too expensive.  It really has great benefits for buyer and seller and has negatives for banks that loose out on making loans and real estate agents.  A seller can more likely sell his house as a for sale by owner if he is offering a program like this, so the seller is less likely to need an agent to sell her house.</p>
<p>Giving back all the rent paid is pretty similar to a 12 per cent discount in the price, which is pretty similar to the combination of a real estate commission and making mortgage payments for six to seven months waiting for a buyer to be found by your real estate agent.</p>
<p>Famous Rental also will close at a title agent or attorney&#8217;s office and even the beginning of the lease option period can be done at title agent or attorney, but is done so at the choosing of the buyer, who pays the closing costs.</p>
